PUMP VIP TERMS & CONDITIONS
No purchase is necessary to become a Pump ViP member. Pump Salon Inc. reserves the right to limit eligibility of certain promotions/giveaways to paying clients of Pump Salon Inc. Paying client is defined as a client who has visited the salon and purchased a service or product within 12 months prior to the closing date of the promotion.
Pump Salon Inc. reserves the right, at its sole discretion, to terminate the Pump ViP program, and to alter, limit, modify or add to the Pump ViP program rules, regulations terms and conditions, including but not limited to imposing time limits and changes to promotions or giveaways, all without prior notice, at any time.
Pump ViP prizes, promotions or giveaways have no cash value. No exchanges or refunds will be granted. Pump Salon Inc. is not responsible for lost or stolen tickets, prizes or giveaways. Once the possession of the Pump ViP prize has been transferred to the winner, we no longer accept liability for lost or stolen items. Furthermore, Pump Salon Inc. is not responsible for the actions of a prizewinner at any event at any time.
We occasionally send mailings to Pump ViP members with discount offers and information about Pump Salon or Pump ViP events and giveaways. If you prefer not to receive such mailings, you may unsubscribe from our list.
Employees of Pump Salon Inc. are not eligible for participation in the Pump ViP program.
All photos and videos uploaded through the Pump Salon ViP website or uploaded through the Pump Salon ViP Photobooth are the property of Pump Salon Inc. Pump Salon Inc. reserves the right to utilize these photos or videos in advertisements including but not limited to Web Advertisements, Magazine and Print advertisements, TV advertisements and Billboard Advertisements.


PARTICIPATION IN THE PROGRAM

Enrollment, membership and all related benefits of the Program are offered at our discretion. By enrolling or using the Progra, you agree that you have read and understand these Terms and Conditions and are bound by all of them, as changed from time to time, and you consent to our collection and use of your personal information in accordance with our Privacy Policy.

Members can only enroll in the Program for themselves, members cannot represent or act as proxy for other members or non-members.

Pump Salon Inc. reserves the right at any time to limit Program enrollment. We may discontinue membership privileges through fraud or theft or otherwise illegally or not as authorized in these Terms and Conditions or in other current Program rules. These rights are in addition to any other legal or equitable remedy which may be available to Pump Salon Inc. under applicable law.


MEMBER OBLIGATIONS

Members shall comply with all rules, laws, and regulations that are applicable. Members acknowledge that they may only participate in the Program if and to the extent that such participation is permitted by such laws, rules, and regulations. Pump Salon Inc. may refuse at any time to enroll a member, or to restrict, modify, or terminate a member's participation in the Program without liability to the member or any other party, if a member violates any law, rule, or regulation, or if a Member's participation in the Program violates any law, rule, or regulation.

Members agree not to forward any Pump ViP promotions or offers to other Members or non-Members without first obtaining the express written permission of Pump Salon Inc. Pump Salon Inc. offers are specifically targeted to individual Members unless otherwise stated.

Members agree to provide only accurate and true information to Pump Salon Inc. at all times.

Members agree to comply with all terms and conditions herein and in of, partner offers, and promotions at all times.

Members agree to promptly notify Pump Salon Inc. of any change in address (mail or email) by updating personal information at www.pumpsalon.com.


LIMITATION OF LIABILITY

We do not have any responsibility or liability for any expense, loss, cost, injury, damage, delay, travel cancellation, accident or any other matter or thing whatsoever (collectively, "Costs"), however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to (i) the Program or your participation in the Program; (ii) any offer, representation, statement or claim about the Program, any Partner or Supplier or their products or services, made by a Partner, Supplier or any other person; or (iii) the purchase, redemption for or use of any goods or services of Partners or Suppliers, including any Awards, whether made available by us, any of our affiliates, Partners, Suppliers or otherwise. This applies even if we or our representatives are advised of the possibility of such Costs. Partners are not responsible for the Program.

NO WARRANTY

PUMP SALON INC. PROVIDES ITS WEB SITE AND SERVICES "AS-IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. AND ITS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.

TERMINATION, CHANGES AND BREACH

Pump Salon Inc. reserves the right, at its sole discretion, to suspend or terminate the Pump ViP program. We may make these changes to any aspect of the Program, all without notice.

GENERAL

These Terms and Conditions may be different from what you know about the Program. These Terms and Conditions constitute the entire agreement between you and us regarding your participation in the Program and your entitlement to any other benefits of the Program, and supersede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory or otherwise. When you deal with us over the Internet, you consent to the formation of contractual relations through electronic communications. We are the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Program or any Award.
